In November 1994, Perry Anthony Cribbs was convicted of killing Linda Harris in Memphis, Tennessee, with no physical evidence linking him to the crime. Cribbs’ conviction was based on the questionable eyewitness identification of Harris’ husband and the unreliable testimony of Cribbs’ then mentally ill, drug addicted girlfriend. Because Cribbs’ attorneys failed to investigate his case, the jury never heard testimony from an alibi witness or a witness who had information that others, including Mrs. Harris’ husband committed the crime. The jury never heard from Linda Harris’ family and friends who knew that Harris’ husband had motives to have her killed.

Linda Harris was shot and killed between 1:30-2:00 a.m. on January 2, 1994 after returning home from a party with her husband. According to Mrs. Harris’ husband, Sidney Harris, two men wearing black ski masks were inside the house when he and his wife came home. There were no lights on in the house. The only light into the house came from the carport. Linda Harris was fatally shot first, and then Mr. Harris was shot in his left shoulder and lost three fingertips. The day after his wife’s murder, Mr. Harris told police that he could not identify the perpetrators as they were wearing black ski masks.

After a fight between Perry Cribbs and his girlfriend, Jacqueline “Jackie” Cannon, Jackie’s brother called Crime Stoppers and reported that Mr. Cribbs was involved in Linda Harris’ murder. He told police that his sister told him that Perry told her he was involved. Jackie and her brother received $1,000 which they split. Ms. Cannon did not go to the police after talking to her brother. When police tracked her down six weeks after the murder, Ms. Cannon told them that Perry confessed to killing Linda Harris. Jackie Cannon was addicted to crack cocaine both when she made her statement to police and when she testified against Cribbs at trial. Three witnesses testified at a post-conviction hearing that Ms. Cannon was addicted to crack cocaine and had paranoid hallucinations. She was later diagnosed with schizophrenia. Cribbs’ trial attorneys were aware that Cannon was addicted to crack but never investigated her drug use or mental state.

After his arrest, Cribbs’ photo was released to the media and shown on the local news. Mr. Harris, who previously told police that he could not identify the perpetrators, was shown a photo lineup of suspects and then identified Perry Cribbs as the shooter. At the trial, Mr. Harris testified that he could identify Cribbs because the perpetrators wore nylon masks, testimony completely inconsistent with his original statement to police that he could not identify the perpetrators because they had on black ski masks. Additionally, the murder weapon was never found nor did the police ever arrest anyone else, though Mr. Harris told police there were two perpetrators.

When Perry Cribbs was arrested he told police that he was playing basketball with his friend, “Frog,” who real name is Eugene Bowen, on the night of the murder. However, Cribbs’ attorneys never attempted to contact Mr. Bowen. At the post-conviction hearing, Mr. Bowen testified that he and Cribbs spent New Year’s night drinking beer and playing basketball which they were playing into the early morning hours of January 2, 1994.

On February 12, 1994, two days before Cribbs’ arrest, a Shelby County jail inmate named James Parker contacted Memphis homicide detectives and told them that he was present when a man he identified as Sidney Harris asked a drug dealer to find someone to kill his wife. According to Mr. Parker’s statement, Sidney Harris owed the dealer money.

Mr. Parker said he was also present days later when three men, who he identified by nicknames, talked about killing Linda Harris. They said they should have killed the husband too instead of only wounding him. The detectives assigned to the case did not follow up on the lead nor did Cribbs’ trial attorneys ever attempt to contact Parker or anyone named in his statement. At the post conviction hearing, Mr. Parker stated that he served his time for the petty crime for which he was in custody and did not expect to receive a deal for providing information to the police. Other witnesses testified at the post-conviction hearing that Sidney Harris was involved in the sale of drugs.

Neither the state nor Cribbs’ attorneys talked to the family and friends of Linda Harris, several of whom, at the post-conviction hearing, testified to the problems in the Harris marriage and about Sidney Harris’ behavior before and after his wife’s death. Sidney Harris did not have a job, often left home for long periods of time, and had at least one girlfriend of whom Linda Harris was aware. One of Linda Harris’ sisters testified that on one occasion, Mrs. Harris called her crying because Sidney had hit her head into the window. In the weeks before her death, Linda Harris wrote a letter to her sister expressing concern about what would happen to her daughter if something happened to her. Family members were aware that Linda Harris’ life insurance was changed before her death and that there was a gun in the home. Sidney Harris did not attend his wife’s funeral even though he had his doctor’s permission to do so, and even Mr. Harris’ own brother called police and told them that he did not think his brother was telling everything he knew about the murder.The police still never pursued Harris as a suspect, and again, Cribbs’ trial attorneys never investigated Harris or talked to his brother, even though they were aware of his brother’s statement.

One week before trial and with an incomplete investigation, Cribbs’ lead attorney withdrew from the case due to illness, and second counsel took over. New counsel did not ask for a continuance in order to complete the investigation. Another attorney was appointed as co-counsel but did not have time to prepare before trial. Co-counsel considered herself to be a “water girl,” as she was only there to “carry water” for the lead attorney.

Perry Cribbs maintains that he is innocent of this crime and has no knowledge of Linda Harris murder. This case demonstrates the problems that currently plague the death penalty system, including grossly inadequate representation at trial and faulty eyewitness testimony. With no physical evidence connecting him to the crime, Cribbs received a death sentence. Perry Cribbs deserves a new trial with effective attorneys in order to get a fair hearing and to present the overwhelming evidence of his innocence.

On December 21, 2009, the Tennessee Supreme Court ruled that Perry Cribbs should get a new sentencing hearing in this case. The case will be remanded back to the trial court for sentencing.

Just after 4am this morning, the Connecticut Senate voted 19 to 17 to repeal that state’s death penalty. This follows the unexpectedly overwhelming 90-56 vote in the House last week. The bill is now on its way to the desk of Connecticut Governor Jodi Rell, who in media reports is saying that she still supports the death penalty and is suggesting that she may veto the bill.

On May 14, Diann Rust-Tierney wrote a compelling article for The Huffington Post concerning the Paul House case and its implications for other cases of possible innocence, specifically the case of Troy Davis. Davis currently sits on Georgia’s death row and is awaiting a decision in his case by the U.S. Supreme Court. In 1991, Troy was convicted in the murder of off-duty police officer Mark MacPhail largely on the basis of eyewitness testimony – no physical evidence links him to the crime. Since his trial, seven of nine eyewitnesses have recanted their original statements, yet federal law prevents these new eyewitness statements from being heard.Troy’s execution had been scheduled for September 23rd, 2008. On September 12, 2008 he was denied clemency by the Georgia Board of Pardons and Paroles. Two hours before he was to be killed he received stay from the U.S. Supreme Court pending its decision as to whether it would hear his appeal. On October 14, 2008, the Court denied his request for relief so that his evidence of innocence could be heard in a legal proceeding. Just one day later, Troy Davis’ execution was set for October 27 at 7pm EST. On October 24, the 11th Circuit Court of Appeals issued a stay pending further examination and possible acceptance of a new appeal. On April 16, by a 2-1 vote the 11th Circuit Court of Appeals denied Troy’s appeal but issued a 30 stay to allow time for an appeal to the U.S. Supreme Court.

As I was getting ready for work today I walked out of the bathroom to hear Paul House’s name on the Channel 4 News. I ran to the screen only to catch a segway into the next news brief. Shrugging it off, I figured it was a quick update to the June 1 retrial or another trial extension request, as it’s happened twice before. I figured I could check the story online when I made it into the office.

Much to my surprise, as I walked in the door of TCASK this morning, Joyce House was calling on our phone. “We have good news today,” she said. “Paul’s been exonterated! We talked for a moment of the relief and joy that the House family is feeling today after 23 years of frustration and fighting for Paul’s life.

After what has seemed like months or years of testing of the DNA evidence preserved from the 1985 rape and murder of Carolyn Muncey, District Attorney Paul Phillips finally requested for the murder charges held against Paul House to be dropped. Special Judge Jon Kerry Blackwood accepted such request and now, after 22 years on death row, Paul House is free.

Paul House joins the ranks of over 130 men who have been released from death row after evidence of their wrongful convictions have emerged (often DNA evidence). This long battle over the guilt or innocence of Paul is a perfect example of the millions of dollars that are fueled into our death penalty system, often with a final result being the reversal of sentencing and also the risk of condemning and killing an innocent man.

We rejoice with the House family as they feel some relief from this long struggle but also acknowledge and share our greivance with the Muncey family as their loved one’s case now has become unsolved.

Yesterday a Colorado bill that would have repealed the death penalty and dedicated the savings to solving cold cases failed by just one vote in the Senate. The Colorado House voted in favor of repeal by one vote last month. The bill would have redirected $1 million currently spent on the death penalty to the Colorado Bureau of Investigation for investigating unsolved crimes known as cold cases of which Colorado has 1,400. Senator Morgan Carroll, a Democratic co-sponsor of the bill, believed passage of this legislation would have resulted in more cases solved and more killers held accountable. “Justice at least means: find the person who did it,” Ms. Carroll stated.

Though the bill did not pass, with a vote of 17-18 in favor of the legislation, yet another state demonstrates that public confidence and support of the death penalty is faltering. Citizens are becoming more educated about the failure of the death penalty as a public policy and lawmakers are listening. The death penalty is often hailed as serving victims and their families, but with precious resources spent on pursuing the death penalty, at least 1,400 victims of murder in Colorado have yet to have their cases solved. What about those victims and their families?

Kudos to all in Colorado whose organizing efforts catapulted that state’s movement towards abolition into the national spotlight and who are now poised for success in the next legislative session.

Yesterday Paul House’s federal public defender, Stephen Kissinger, argued before a three judge panel of the 6th Circuit Court of Appeals in Cincinnati that the state of Tennessee has persisted in a pattern on delay in dealing with the Paul House case and should be barred from trying him again for the murder of Carolyn Muncey.

Kissinger informed the court that every additional piece of evidence tested for DNA in preparation for this new trial, at the taxpayer’s expense, has not matched House and only bolstered his claims of innocence.

Judge Gilbert Merritt pushed the state as to whether or not it would ensure that this trial happen in June and could not get a straight answer. The Judge went on to state that there appeared to be “pure stubbornness and vindictiveness on the part of the state” in its unrelenting pursuit of House given that the U. S. Supreme Court ruled in 2006 that if the new evidence had been presented at the time of his trial, no reasonable juror would have convicted him.

The panel has taken the case under consideration and did not indicate when it would rule.

The House case is one more example of the state’s inability to admit an error. Instead, untold resources are being wasted on this pursuit of House who already spent 22 years on Tennessee’s death row and who currently is confined to a wheelchair with aggressive multiple sclerosis.

Yesterday the U.S. Supreme Court ruled in a 6-3 decision that Tennessee death row inmate Gary Cone deserves a new hearing to determine whether evidence withheld by the prosecution in Shelby County would have changed the jury’s mind about imposing the death sentence.

Cone, a Vietnam veteran, who suffered from combat stress, mental illness, and a drug addiction, claims that he was in an amphetamine psychosis when he killed elderly Memphis couple, Shipley and Cleopatra Todd, while hiding in their home after a robbery of a jewelry store in 1980.

At the time he was tried, prosecutors called his addiction “baloney” and told jurors that Cone was a drug dealer and cold-blooded killer and not an addict. However, the prosecutor withheld information that substantiated Cone’s claims, including police and FBI communications identifying Cone as a drug user and addict and witness statements describing his behavior as “weird” and “wild-eyed.”

Paul Bottei, Cone’s federal public defender, said that Cone first requested access to files from the district attorney’s office in Memphis in 1993. The Supreme Court has twice reinstated Cone’s death sentence on different appeals, but this current issue about his mental state is his strongest claim.

During arguments before the Supreme Court, the justices demonstrated outrage at Tennessee prosecutors for not turning over all the evidence to Cone’s defense attorneys.

“You’re saying that the lawyer, the trained lawyer for the government, who knew this information and knew the defense, just what? Just overlooked it by accident?” Justice Stephen Breyer demanded of Jennifer Smith, representing Tennessee.

Later, Justice David Souter addressed Smith saying, “I believe you have just made a statement to me that is utterly irrational.”

The justices sent the case back to U.S. District Court Judge Jon McCalla to determine whether or not there is a reasonable probability that the withheld evidence would have altered the penalty Cone received.

After hearing such stories, I must ask the question, “What are the consequences for the prosecutor who withheld this valuable information which could potentially cost Gary Cone his life and has cost taxpayers untold dollars in pursuing appeals to get to the truth?” I thought a prosecutor’s first responsibility is to pursue the truth and to ensure that those who commit crime are held accountable for their crimes, not to get convictions and death sentences at any cost.

The murder of this elderly couple is tragic and reprehensible, and I am sure that there was immense pressure on the district attorneys’ office to pursue the death penalty for Cone. However, it is inexcusable that this prosecutor, an officer of the court, knowingly withheld this evidence from the defense at the trial. How is he/she being held accountable? If you or I lied to the court regardless of our reasons for lying, we could be charged with perjury. Until we start holding everyone involved to the same standards with real consequences, this system will remain as flawed and broken as ever.

Gary Cone’s conviction stands. He has been in prison for nearly 30 years. The question for the courts now is not Cone’s guilt but the tactics by which a sentence of death was secured when other options were available. Such actions are not only unfair to the defendant but to the jury who didn’t have all the facts needed to render their decision, to the court itself, and to all citizens who expect our court officers to follow the law.

For TCASK’s 2009 Justice Day on the Hill, the bill was House Bill 1496, enacting a one year moratorium on Tennessee’s death penalty. While the Schoolhouse Rock video is educational, there is a lot more that goes into bill passage than a three minute video can depict. One of the most important factors in bill passage is citizen lobbying.

Justice Day brings concerned Tennesseans from across the state to meet with their legislators. A face to face meeting is the most effective way to advocate for the passage of a bill. The day began with a stark reminder of why we were there. In a press conference organized by TCASK, Michael McCormick and Joyce House both spoke. Michael was on Tennessee’s death row for 20 years before finally receiving an acquittal in a new trial. Joyce’s son, Paul House, was on Tennessee’s death row for 23 years before being released where he is now awaiting retrial. Tennessee’s death penalty is broken. Innocent people are caught up in the system. This is why Tennesseans came to Nashville to meet with their legislators.

For some folks, this was their second, third, or even fourth Justice Day on the Hill. They strode into their legislator’s office with confidence. For others, this was their first time walking through the Tennessee statehouse. They were participating in the democratic process and initiating a relationship with their elected officials. For all, it was a reminder that while we have come a long way, we still have a long way to go. Legislators are turning to TCASK for thoughtful and objective education on the death penalty. They respect our mission and drive. However, there are still those who are clouded by misconception and myth. TCASK will continue to provide clarity to the brokenness of the death penalty system. And someday, as more legislators realize that supporting a broken system does not serve their constituents or the state of Tennessee, we will not by lobbying for a moratorium, but for repeal of Tennessee’s death penalty.

On March 26th the New Hampshire House of Representatives became the first legislative body in the country to pass a crime victims equality act to prohibit discrimination against family members of murder victims who oppose the death penalty. HB 370, “An act relative to the treatment of victims of crime”, was passed by a 213-114 margin. This bill amends New Hampshire’s Crime Victims Bill of Rights by adding this new right to crime victims:

” The right to all federal and state constitutional rights guaranteed to all victims of crime on an equal basis, and notwithstanding the provisions of any laws on capital punishment, the right not to be discriminated against or have their rights as a victim denied, diminished, expanded, or enhanced on the basis of the victim’s support for, opposition to, or neutrality on the death penalty.”

Not all victims feel the same way about the death penalty. In fact, the sponsor of HB 370, Rep. Renny Cushing, is himself a murder victim’s family member whose father was murdered in 1988.

The Tennessee Committee to Study the Administration of the Death Penalty, which met from October 2007-February 2009, also discussed a process for ensuring that all victims’ families are treated the same by the system regardless of their position on the death penalty. Charles Strobel, whose mother was murdered and who represented Murder Victims’ Families for Human Rights on the Tennessee Study Committee, suggested the creation of an independent office for the victim’s advocate. Currently, the victim’s advocate is located in the office of the district attorney, the same office which decides whether or not to seek the death penalty.
