The state of Tennessee is now seeking at execution date for Edward Jerome (E.J.) Harbison after a federal judge dismissed a lawsuit over Tennessee’s lethal injection protocols.   

Harbison was sentenced to death for beating an elderly woman to death during a botched burglary in 1983 in Chattanooga. He had been scheduled to be executed in January 2008  but was granted a stay based on his challenging the constitutionality of Tennessee’s lethal injection protocols. In 2007,  District Judge Aleta Trauger ruled that Tennessee’s lethal injection protocols did, in fact, violate Harbison’s Eighth Amendment right to freedom from cruel and unusual punishment. Since that time, the U.S. Supreme Court has ruled that the current lethal injection process used across the country is constitutional.

Harbison’s case is rife with issues of fairness, arbitrariness, and ineffective assistance of counsel.  Regardless of one’s opinions about the death penalty, it is difficult to look at Harbison’s case and maintain that the process was fair and equitable.  You can read a summary of Harbison’s case on our website under the heading “Cases.”

Though we remain deeply grateful for the outcome in the case of Gaile Owens, the fact remains that Tennessee has now set two executions dates before the end of  2010 and is seeking two additional dates. If these executions happen, almost as many people will be executed in 2010 than in the state since 1960 (only 6 have been executed in that time frame and all since 2000).

A growing number of law enforcement officials are questioning the effectiveness of the death penalty. In particular, many members of law enforcement do not believe that the death penalty is a deterrent and are concerned about the continued risk of executing an innocent person. Our law enforcement members are dedicated men and women who truly serve our communities by removing criminals and keeping our streets safe. At the same time, members of law enforcment increasingly question whether the death penalty is the smartest way to respond to and ultimately prevent violent crime.

Tennessee’s gubernatorial candidates are not talking about Governor Bredesen’s recent commutation of Gaile Owens’ death sentence, though all of them have stated their support of the death penalty.

In yesterday’s Tennessean, the candidates share their thoughts concerning the broader issue of the death penalty and those factors that might influence their future decisions.  Candidates highlight the importance of respecting a jury’s decision, the length of the appeals process to sort out problems, and the presentation of new evidence.

However, these particular factors do not fully take into account the serious process issues currently inflicting the death penalty system in our state. Case after case demonstrates that a number of juries do not receive all the facts at trial often because of ineffective assistance of counsel (particularly for indigent defendants) or because evidence may be withheld from the defense until years later.  How can we have faith in a jury’s verdict if the jury isn’t given all the facts?   

As to the lengthy appeals process, the appeals court only reviews the trial record.  Again, if certain evidence or issues are not addressed at trial, the appeals court does not have to consider them.  And, if new evidence does become available, it may take years to get a court to hear that evidence, as in the case of Paul House.  House had DNA evidence available in the 1990’s indicating his innocence, but no court would consider it until the U.S. Supreme Court weighed in on the matter in 2006.  Still, it was 2009 before his conviction was thrown out and all charges were dropped after 23 years on death row.

I understand the candidates’ reluctance to comment on Governor Bredesen’s decision on Owens’ case as they respect that he is the current Governor, and the decision was his to make.  However, if one only relies on a jury’s verdict or the appeals process to address the critical issues at play in some of these cases (as the candidates seem to indicate they would),  justice will not always be achieved.  The fact remains that in the Owens’ case, the jury never received critical information which was available at the time of the trial (not new evidence) and that the courts considered her appeals for 24 years without offering any remedy for the egregious problems in her case, including the utter disproportionality of her sentence compared with similar cases.  In Owens’ case as with others, the Governor was the last hope for addressing the issues of fairness that must be addressed if we are to have any faith that the system is working for every Tennessean.   

Rep. Zach Wamp, one of the four gubernatorial candidates, stated in the recent debate that ruling on death penalty cases is “the toughest thing that a governor can be called to do.”  I fully agree with Rep. Wamp, which makes it all the more important for the next Governor to gather all the necessary information to make the most informed decisions in these cases, including the failures of the system as a whole.

My hope is that whoever is ultimately elected to serve as Governor of our state will be open to learning as much as possible about Tennessee’s death penalty system from all viewpoints and will consider the real failures and costs of the current system to ensure that Tennesseans have a policy that is not simply tough but effective.

The state Supreme Court has recently set execution dates for two inmates, Stephen Michael West and Billy Irick. Though we continue to celebrate the commutation of Gaile Owens’ sentence, we are saddened by the announcement of these scheduled executions. West’s date has been set for November 9, 2010, and Irick’s date is set for December 7, 2010. As with many cases, these two cases both have critical issues that need to be looked at, including disproportionate sentencing and mental illness.

We are deeply grateful to Governor Bredesen for commuting Gaile Owens’ sentence. It was the right thing to do and we could not be more thankful for the consideration Gov. Bredesen gave to this case. During the press conference, Gov. Bredesen addressed two of the points he thought were the most important in this case when considering the severity of the punishment: 1. the possibility of abuse in her marriage and the psychological conditions that can result from such abuse, and 2. the fact that Ms. Owens accepted a life sentence in exchange for a guilty plea prior to her trial. Because the man who actually committed the murder did not accept the plea bargain (the condition attached to the plea bargain), Gaile received a death sentence. Gov. Bredesen also reviewed 33 cases similar to Gaile’s case. Almost all of the similar cases in Tennessee have resulted in life sentences.

Again, we are so grateful to the Governor, and we think this a just and appropriate decision.  To all of you who signed the petition, wrote letters to the Governor, and spoke out on this issue– thank you. This is evidence that when we all come together, we can make a difference.

An analysis of death penalty costs in Indiana demonstrated that the average cost to a county for a trial and direct appeal in a capital case was over ten times more than a life-without-parole (lwop) case. The average death case cost $449,887, while the average cost of a lwop case was $42,658.  The study, prepared by the Legislative Services Agency for the  Indiana General Assembly, found that even when factoring in longer periods of incarceration for inmates receiving lwop, the cost of the death penalty was still far greater than the cost of lwop.   Read more here. 

In testimony before the Tennessee Committee to Study the Administration of the Death Penalty in 2007, the Tennessee’s comptroller’s office admitted that the state had no way to track the true costs of Tennessee’s death penalty because the data is not centralized, and therefore, not readily available.  In a cash-strapped state like Tennessee, this lack of cost data in unacceptable.  Regardless of how one feels about the use of the death penalty, precious resources should not be wasted on this unfair and inaccurate system when Tennessee has life-without-parole as a sentencing option.

In today’s Tennessean, Clay Carey reports that Tennessee’s attorney general has requested that an execution date be set for death row inmate, Edmund Zagorski, who was convicted and sentenced to death for the murders of John Dotson and Jimmy Porter in 1983.

This request is the fourth that the attorney general has made to the court since December of 2009. Currently, Gaile Owens is scheduled to be executed on September 28, though she has requested that Governor Bredesen commute her sentence.  No dates have been set for the other three: Billy Irick, Stephen West, and now Edmund Zagorski.

Tennessee has executed only 6 people since 1960, all of them since 2000. Given that the death penalty is coming under increasing scrutiny across the nation because of serious problems concerning accuracy, cost, and fairness of application, it is alarming that Tennessee is moving forward with these executions.

Many would argue that these inmates have had more than enough time for the courts to determine if problems exist in their cases so that the problems can be remedied. However, those of us who work up close to the death penalty everyday, know that the system doesn’t always work that way.

Take Gaile Owens’ case for example.  This case has been litigated since 1985, and still, all the facts have not been adequately taken into account: the fact that the jury never heard evidence that Gaile suffered from battered woman’s syndrome and that she was willing to plead guilty for a life sentence only to have the offer revoked when her co-defendant would not plead; the fact that her attorneys spent just 2 hours preparing for the sentencing portion of her trial; the fact that the district attorney withheld critical evidence substantiating Gaile’s claims of her husband’s infidelities; the fact that her sentence is grossly disproportionate to the sentences of others in Tennessee for similar offenses (Gaile is the only one with a death sentence). 

The courts also looked at the cases of Paul House and Michael McCormick for over 20 years each before their convictions and death sentences were finally overturned, and these men had DNA evidence available. Should their be timelines on the pursuit of justice? How long is too long for uncovering the truth, for providing equal access, and for fallible systems and human beings to determine who is entitled to live and who deserves to die?

Why do we  ask victims’ families to endure 20 years of agony waiting on these death sentences to be carried out when the inmates could have received life sentences (51 years minimum before parole eligible) or life without parole, and spared these families all of this waiting while allowing us to remedy mistakes if they are made?
