The Chattanooga Times Free Press published an editorial today on the death penalty that includes statements from TADP Executive Director Stacy Rector and Joyce House, the mother of former Tennessee death row inmate Paul House, who was exonerated in 2009 after DNA evidence revealed that he was not the perpetrator. Dr. David Gushee, a professor of Christian Ethics at Mercer University, joined Rector and House in raising concerns about the many problems with the death penalty and called for its abolition. Tennessee State Representative Barrett Rich, a supporter of the death penalty, was also interviewed.

James Abbott, a police chief in New Jersey, recently wrote a compelling opinion editorial in Delaware’s The News Journal in which he explained his change of heart when it comes to the death penalty and encouraged Delaware and other states to repeal their death penalty like his state did.

Abbott was asked to be part of a commission to study the death penalty in 2006 and discovered through that process the devastating impact it has on victims and the prolonged pain and uncertainty that they must endure.

“If I learned one thing listening to their stories, it was this: Should I be killed in the line of duty, I would not want my killer to face the death penalty,” writes Abbott. “Why? Because I now understand what my family would have to go through, and it’s just not worth it.”

He also came to realize that the death penalty is an extremely costly system that drains resources from other areas that could be used to more effectively fight crime. “As a police chief, I find this use of state resources offensive,” said Abbott. “The death penalty is supposed to help me fight crime, but it doesn’t. I say: Give a law enforcement professional like me the money that’s being wasted on the death penalty and I’ll show you how to reduce crime. The death penalty isn’t anywhere on my list.”

Last night, TADP traveled to Knoxville for an event to raise awareness about the problems with our broken death penalty system as part of the Amnesty International’s  2013 Human Rights Week at the University of Tennessee. The featured speaker was Ray Krone, the 100th death row exoneree in the U.S. and the Director of Membership and Training at Witness to Innocence, an organization working to end the death penalty that is composed of, by and for exonerated death row survivors and their loved ones.

Krone explained to the crowd how he endured two trials and numerous appeals before being released after ten years behind bars when DNA evidence pointed to the real perpetrator. The Knoxville News Sentinel covered the event and wrote a great article reflecting the evening’s conversation.

A newly formed group called Conservatives Concerned About the Death Penalty, a network of conservatives questioning the alignment of capital punishment with conservative principles, is making their debut at this year’s Conservative Political Action Conference (CPAC) being held near the nation’s capitol March 14-16.

The group grew out of Montana Conservatives Concerned About the Death Penalty, which was founded by Roy Brown, former Majority Leader of the Montana House of Representatives, a former state senator and a republican candidate for Montana governor in 2008. Brown will be joined at CPAC by other conservative leaders from Montana, Kentucky, Texas and Kansas.

“Conservatives from across the country have joined this effort since I first called for repeal of the death penalty as Majority Leader in 2003,” Brown said. “Today, in addition to the sanctity of life issue, conservatives are questioning the exorbitant costs, the errors that risk innocent lives, and the impact the system has on victims’ families.”

Richard Viguerie, known as the “Funding Father” of the conservative movement, also supports Conservatives Concerned About the Death Penalty. “Conservatives have every reason to believe the death penalty system is no different from any [other government programs] which we conservatives know are rife with injustice,” he said.

Also in attendance will be Jay Sekulow, Chief Counsel for the American Center for Law and Justice. “Conservatives should question how the death penalty actually works in order to stay true to small government, reduction in wasteful spending, and respect for human life,” said Sekulow.

Conservatives Concerned About the Death Penalty is a project of Equal Justice USA, a national, non-partisan, grassroots organization working to build a criminal justice system that is fair, effective, and responsive to everyone impacted by crime.

Public Policy Polling recently surveyed 600 North Carolinians by telephone and found that a majority of respondents prefer replacing the death penalty with a sentence of life without parole (LWOP) if some requirements are put in place to specifically help victims. According to the survey, 68 percent said they support replacing the death penalty with LWOP if the offender had to work and pay restitution to the victim’s family. Sixty-three percent support repealing the death penalty if the money saved was redirected to effective crime fighting tools, while 55 percent support ending the death penalty if the money saved was redirected to solving cold cases and assisting crime victims.

Of those surveyed, 44 percent identified themselves as conservative. Sixty-five percent of those who called themselves “somewhat conservative” and 50 percent of those who self-identified as “very conservative” supported switching to life in prison without parole.

“The days when the death penalty enjoyed near-universal support are clearly over. Across the country, poll after poll has shown that,” said Tom Jensen, director of Public Policy Polling. “These results show that people in North Carolina are willing to consider alternatives to capital punishment.”

North Carolina has not executed anyone since 2006 and no new death sentences were handed down last year for the first time in 35 years. Five states have abolished the death penalty in the last five years, and Maryland will likely soon become the sixth. With other states like Delaware, Colorado and Montana poised to repeal the death penalty in the near future, we are witnessing a shift in attitudes about the death penalty as the public learns of the many problems with the system and realizes alternatives are available that can still provide for public safety and would do more to help victims.

And another update: Friday, March 8: More good news! The Maryland House Judiciary Committee voted 14-8 to pass repeal this afternoon. Now the bill will go to the House floor next week. Update Tuesday, March 5: The Maryland Senate debated the death penalty repeal bill on Monday evening and this morning and many unfriendly amendments were soundly defeated. The Senate will take a final vote in its third and final reading, now set for 9am EST tomorrow (March 6). Then the House of Delegates takes up the bill starting with a vote in the House Judiciary Committee.

After debating about the death penalty for three and a half hours this morning, the Maryland Senate took a key test vote on an amendment proposed by Senator Richard F. Colburn (R-Dorchester) that would retain the death penalty for certain cases with aggravated factors. The amendment failed on a vote of 27 to 19 and the Senate adjourned. They are scheduled to resume debate on Governor Martin O’Malley’s death penalty repeal bill on Monday at 8:00 p.m. (EST).

Death penalty repeal advocates say they are confident that they have enough votes to defeat any other amendments that may be proposed on Monday and feel that they will win in the final Senate vote which they hope will happen by next Tuesday. The bill needs 24 votes to pass and 26 senators have already said publicly that they intend to vote for it. Senator Allan H. Kittleman (R-Howard) joined them in voting against Colburn’s amendment today, though he said he continues to wrestle with how to vote on the repeal bill.

Two Senators in particular fought hard for repeal in Maryland today – Jamie Raskin and Lisa Gladden. You can thank them for their leadership and encourage them to continue to stand strong!
