Two More Death Row Exonerations

On Tuesday, Henry Lee McCollum and Leon Brown walked out of a North Carolina prison where they had spent the last 30 years. McCollum, the state’s longest serving death row inmate was freed after DNA connected the crime to someone else. He had been on death row for over three decades – since he was 19 years old. Leon Brown, McCollum’s brother, was also released.

The only evidence tying McCollum and Brown to the crime were coerced confessions that law enforcement obtained from the disabled teens (who, even as adults, have the intellectual ability of children)–the only evidence tying them to the crime. McCollum first told police that he knew nothing about the murder, but at 2 a.m. on Sept. 29, 1983, after five hours of intense interrogation, he signed a confession written by police. Soon after, his younger brother, Brown, also confessed.

McCollum and Brown were originally prosecuted by Robeson County District Attorney Joe Freeman Britt, whose nickname “World’s Deadliest DA” was earned after he won nearly 50 death sentences during his 12 year career as chief prosecutor. At that time, there were no laws exempting juveniles or those with intellectual
disabilities from the death penalty.

In 1991, courts granted the brothers new trials because of improper jury instructions. Brown’s murder charge was dismissed, but he was convicted of rape and given a life sentence. McCollum was again convicted of murder and sentenced to death.

In 1994, When the Supreme Court decided not to review a death row case out of Texas, Justice Harry A. Blackmun dissented, arguing the death penalty was cruel and unusual and therefore unconstitutional.
Scalia responded to Blackmun’s dissent by referencing the McCollum case and arguing that the death penalty was appropriate for the most heinous crimes, “For example, the case of an 11-year-old girl raped by four men and then killed by stuffing her panties down her throat,” Scalia wrote in Collins v. Collins. “How enviable a quiet death by lethal injection compared with that!”

Justice Scalia’s “case in point” for the use of the death penalty in the U.S. is now a “case in point,” for why the system cannot be trusted to determine who lives and who dies as McCollum and Brown become the 145th and 146th individuals exonerated and freed from death row nationwide.

Had it not been for unrelated execution delays in the state of North Carolina, these men would likely have already been executed. Read more about these exonerations.

TADP Celebrates the Life of “The Citizen” George Barrett

George Barrett, a Tennessee lawyer who long fought for civil rights, died on Tuesday, August 26, at the age of 86. “The Citizen” as he often called himself, defended student demonstrators in the 1960’s  fighting for integration, and decades later, led the defense working for clemency for Tennessee death row inmate, Gaile Owens.  She ultimately was granted clemency and paroled in 2011.

George was always willing to share his insights, experience, and wit with us at TADP, and we are grateful for his legacy and his outspoken opposition to the death penalty.

With the recent death of John Seigenthaler and now George Barrett, we recognize the profound loss felt by our state as well as the contributions that these men made in creating a more more just and equitable place for us to live.  As we mourn, we also can be inspired to take up the mantle and continue the work before us.

Tennessee stands on the precipice of 11 executions, an unprecedented number. We all “the Citizens” of this great state must  act now to keep these executions from happening.  If you haven’t already, please sign the open letter to Governor Haslam, asking him to stop these executions in order for a review of this state’s flawed death penalty system, as outlined by the Tennessee Committee to Study the Administration of the Death Penalty, can be conducted.

Death Row inmates sue over the Electric Chair

With just over forty days until the state of Tennessee is scheduled to resume executions, the Federal Public Defenders Office filed suit on behalf of eleven inmates scheduled to die in the next eighteen months. Kelley Henry, stated, “Today, on behalf of our clients who face imminent execution, we have asked the Chancery Court to allow us to challenge the electric chair as a method of execution because even when the chair works exactly as it is intended, it is a torture device.”

The state legislature overwhelmingly passed a bill to reinstate the electric chair should lethal injection drugs be unavailable for those scheduled to be executed. The bill was passed in April 2014, ironically during Holy Week, which Christians celebrate as the days leading to the crucifixion of Jesus Christ.

The inmates are already involved in a lawsuit to reveal the drugs that would be used to kill them as well as the names of the execution team members. Now the suit has been amended to include the use of the  electric chair in their list of challenges.

All Eyes on Ohio

Lethal injection protocols remain at the center of America’s death penalty debate. On August 11 a federal judge in Ohio extended the moratorium into 2015 given the persistent questions surrounding its two-drug protocol of the sedative midazolam and the painkiller hydromorphone. The ruling effectively postpones executions scheduled for September, October and November. This move by federal judge Gregory Frost is coupled with a report on Tuesday (August 12) concerning the botched execution of Dennis McGuire on January 16, 2014, also in Ohio. An independent examiner, Dr. Kent Diveley, an anesthesiologist at Scripps Mercy Hospital in San Diego, stated “To a degree of medical certainty this was not a humane execution.” Dr. Diveley referenced Ohio’s two-drug protocol and concluded:

“Neither of these drugs combined in the doses can be depended upon to produce a rapid loss of consciousness and death,” the anesthesiologist said. “It is possible when this combination of drugs is used for lethal injection there will be a delay of several minutes before the inmates loses consciousness preceding death.”

Tennesseans should take note of all that is happening in Ohio: With eleven executions – the latest one announced today – scheduled in the next sixteen months, Tennessee’s protocols will be put to the test over and over again unless something is done. The first step toward action came Monday as attorneys for the state are challenging the right of ten death row inmates to know the identities of the execution team and the drugs that will be used to kill them, as ordered by Davidson County Chancery Court Judge Claudia Bonnyman.

Ohio has learned the hard way that it must examine its death penalty system, and Tennessee should follow suit. The state of Tennessee could make the same moves that Ohio has in order to avoid the specter of botched executions. Tennessee could take the necessary time to fully study the issue, as a matter of policy, rather than speeding ahead with the process.

Arizona’s semantic confusion over the death penalty

Joseph Wood execution lasted over 100 minutes, as he – depending upon who you ask – snored or snorted until his death at 3:49 p.m. after being fully sedated at 1:57 p.m.

According to Mauricio Marin, a media eyewitness to the execution, “I continued to scribble on my state-issued notepad, counting the gulps and gasps of the man on the gurney. I counted 660. This went on for over an hour and a half.” Or as Wood’s attorneys put it, “He has been gasping and snorting for more than an hour.” According to Jeanne Brown, a family member of the victims, “I don’t believe he was gasping for air; I don’t believe he was suffering. It sounded to me like was snoring.”

Snoring? This is the state of the death penalty in America now: These are the euphemisms we resort to rather than confront the mechanism before us: what Andrew Cohen calls “a state-sponsored, judicially sanctioned human experiment that went terribly wrong.”

Arizona Governor Jan Brewer, however, assured the watching world of her state’s competency to carry out executions: “One thing is certain, however, inmate Wood died in a lawful manner and by eyewitness and medical accounts he did not suffer,” she said. “This is in stark contrast to the gruesome, vicious suffering that he inflicted on his two victims — and the lifetime of suffering he has caused their family.”But as Radley Balko stated, via Twitter, “Yes, it’s true that ‘Wood’s victims suffered too.’ But perhaps we shouldn’t look to murderers when establishing our baseline for humaneness.”

To Cohen’s point, something did go wrong, though, long before Wood was strapped to the gurney. Over the past weekend, Wood was granted a stay of execution by the U.S. Court of Appeals for the 9th Circuit, all revolving around Arizona’s lethal injection protocols. On Monday, the full court upheld the stay. On Wednesday, however, hours before the execution, the U.S. Supreme Court allowed the execution to carry on as planned, despite the evidence of previously botched executions this year in Ohio and Oklahoma. For instance, Arizona’s two-drug protocol of midazolam and hydromorphone was the same drug combination administered by the state of Ohio to Dennis McGuire, who gasped for nearly half an hour in January.

Wood’s execution began at 1:52 p.m. Wood was sedated at 1:57 p.m. At 2:02 p.m. he began to breathe and gasp. By 3:02 p.m. he was confirmed to still be alive. Forty-seven minutes later he was declared dead during his attorneys’ attempt to secure an emergency stay of execution.

The United States of America is waking up to the realities of the death penalty, and unfortunately, these awakenings come after botched executions in Ohio, Oklahoma, and now Arizona. Which state will be next to wake up in such an unsettling fashion? Will it be Tennessee which like Arizona boasts a lethal injection secrecy law? Will Tennessee’s leaders wake up to acknowledge the brokenness of the system? Will they approve of the ten scheduled executions, with fingers crossed behind their backs, that their state will not join the shameful company of those states that ignored the clear warning signs?

Will they appear to wake up, as Arizona momentarily did, only to groggily hit the snooze button one more time?

Snoring.

Snorting.

When we can no longer tell the difference, maybe it’s time to call the whole thing off.

California Judge says Death Penalty is Unconstitutional

On July 16, U.S. District Judge Cormac Carney ruled that California’s death penalty violates the Eighth Amendment ban on cruel and unusual punishment. Judge Carney, an appointee of President George W. Bush, serving in the staunchly conservative Orange County, concluded the death penalty was arbitrarily administered, not a deterrence to violent crime, and riddled with systemic delays. To put this into perspective, since California reinstated the death penalty in 1978, over nine hundred people have been condemned to die. Only thirteen have been executed. Ninety-four have died of natural causes, and thirty-nine had their cases overturned without the state resentencing them. Nearly 750 people remain on death row, yet only seventeen are cleared to be executed. For this reason, Carney has ruled the timing to be cruel and unusual. In his decision, he stated that no rational jury would support the sentence of “life in prison, with the remote possibility of death,” which is, in essence, what California practices. Currently, the national average time to execution sits at nearly sixteen years. One might think that this is due to endless appeals used by inmate’s attorneys to drag out the process. However, the bulk of the time in California is spent fulfilling mandated procedures, according to Carney, summarized here by the National Law Journal:

  • Death row inmates wait three to five years for counsel to be appointed for their direct appeals, he said. After direct-appeal issues are briefed, two to three years are spent waiting for arguments to be scheduled before the California Supreme Court.
  • In the next step—state habeas review—at least eight to 10 years elapse between the verdict and appointment of habeas counsel. After that counsel is appointed, underfunding hampers investigation of potential habeas claims, Carney said.
  • After habeas briefs are submitted, another four years go by before the state Supreme Court denies the inmate’s claims in a generally conclusory opinion that will slow review of the inmate’s federal habeas claims, he continued. After filing a federal habeas petition, many inmates, because of deficiencies in the state’s process, must go back to state court to exhaust state claims.

These procedures are not the result of clever “lawyering” or Hail Mary appeals, but rather the norm for death row cases. Of course, there are those whose answer to the length of the process might be to shorten it. But, it is also true that a shortened process will only create more risk for the execution of the innocent, a grave injustice that has likely already happened even with the long system we have now. We at TADP hear over and over again from those who are philosophically supportive of the death penalty that if the death penalty is not going to be practiced in a timely fashion then we shouldn’t have it. TADP Gives Thanks for the Life of John Seigenthaler

I learned just about an hour ago that Mr. John Seigenthaler, a renowned journalist, champion of human rights, proud Nashvillian, man of faith, and friend of TADP died today at his home surrounded by the family he loved. He was 86.

I had the profound privilege of meeting with Mr. Seigenthaler on several occasions over the past few years as he offered his insight and guidance to me about TADP’s ongoing efforts to repeal the state’s death penalty.  He was passionate in his belief that the death penalty was an unfair, racially biased, costly policy that did not honor life but only compounded tragedy and compromised human dignity.

Though his plate was always more than full, he never hesitated to help those of us on the front lines of this work when we needed him.  In 2010, Mr. Seigenthaler helped TADP to organize an event at the First Amendment Center,  featuring both national and local experts on the death penalty.  He also  played a crucial role in the successful effort to garner clemency for Tennessee death row inmate Gaile Owens, who came within months of execution, before former Governor Phil Bredesen commuted her sentence in 2011.

TADP board members  Amy Sayward and Margaret Vandiver published a book  of essays a few years ago called Tennessee’s New Abolitionists: The Fight to End the Death Penalty in the Volunteer State.  And once again,  Mr Seigenthaler was there to help, providing a blurb for the back of the book stating:

The meaning of the admonition—four words most often forgotten, ignored or intentionally violated–seems so simple: ‘Thou shall not kill.’  Here nineteen essayists remind us that there have been those among us who understood the meaning—and who sought to give Life to The Law.

Thank you Mr. John Seigenthaler for giving life to “The Law.” We are profoundly grateful.

Tennessee Congregations Encourage Death Penalty Repeal

I was up early on a rainy Sunday morning this week to drive to Pleasant Hill, Tennessee, a small town tucked away on the Cumberland Plateau. The occasion was Pleasant Hill Community Church’s (UCC) annual Abolition Sunday, and I was invited to preach at the service.

This congregation has held an Abolition Sunday now since two of its members attended People of Faith Against the Death Penalty’s Kairos Conference a few years ago in Atlanta. This national conference encouraged congregations to get more involved in working to end the death penalty by educating their members and taking action.  The two individuals from Pleasant Hill took the challenge to heart, and now their congregation is actively engaged in working to end the death penalty in Tennessee with letter writing campaigns, educational forums, participation in TADP’s Justice Day on the Hill, and of course, Abolition Sunday!

And just a few weeks ago now, the Tennessee Annual Conference of the United Methodist Church passed a resolution asking the Tennessee General Assembly and Governor Haslam “to issue a stay on all Tennessee court ordered executions, and to seek alternatives ways to achieve healing and restorative justice for all those who suffer because of violent crimes.”  Through a blog post, Nashville area UMC Bishop Bill McAlilly challenged the recent reinstatement of the electric chair in Tennessee and urged United Methodists to contact their lawmakers expressing their opposition to the death penalty. This blog post led to a rally by Methodists from across the state in Nashville to show lawmakers and citizens alike that this is an issue about which people of faith have something to say.

This engagement by more and more congregations from various denominations statewide demonstrates that Tennesseans are deeply concerned about the recent decisions by our leaders concerning the death penalty and that we seek a better way forward.  It is time to redirect our focus from maintaining a broken death penalty system, to instead focusing our energy and resources on better supporting murder victim’s families, educating our young people, and treating those who struggle with mental illness and substance abuse–all of which will do far more to meet the needs and reduce the violence in our communities than the death penalty ever will.

Let’s Educate Tennesseans – In More Ways than One

Last week three men were executed in Missouri, Georgia, and Florida—the first executions since Clayton Lockett’s botched execution occurred in Oklahoma. Meanwhile at least ten men on Tennessee’s death row face execution dates, the first scheduled for October 7, 2014.

Many of us are asking what more we can do. If you have been following the news over the last few days, you may have noticed stories in your local papers about the recent increases to the cost of higher education in Tennessee, perhaps as high as a 6 percent tuition increase facing students at UT Knoxville as well as tuition and fee increases ranging from 3.5 to 8.6 percent for students at Tennessee Board of Regents institutions. Even community college students at places like Chattanooga State and Cleveland State will see their tuition and fees increase by over 5 percent, as well.

I can speak anecdotally to the concerns college students have over tuition hikes: As a professor I always try to know what my students are experiencing outside of the classroom. New Poll Shows Majority of Americans Prefer Alternatives to the Death Penalty

In a first for ABC News/Washington Post polls, a majority of Americans favor imprisoning convicted murderers for life to the death penalty.

When offered a choice between the two punishments, 52 percent of those polled picked life in prison without parole while only 42 percent choose a death sentence. Without the option of life without parole, support for the death penalty increased to 61 percent.

As the public becomes more educated about the continued failures of the death penalty system and states struggle with how to carry out executions, support for the death penalty will continue to wane.
